Familia Torres Wine Club Membership Conditions
These terms and conditions regulate membership of the Familia Torres Wine Club.
The Familia Torres Wine Club is a project of MIGUEL TORRES, S.A., with registered office at calle Miquel Torres i Carbó, 6, 08720 Vilafranca del Penedès (Barcelona) and C.I.F. A-08933251.
1. What is the Familia Torres Wine Club?
The Familia Torres Wine Club offers its members the delivery of 1 (one) case of wine a quarter; that is, 4 (four) cases of wine a year, upon payment of the corresponding fee, in accordance with the provisions of point 3 of these terms and conditions.
Familia Torres Wine Club members also enjoy benefits linked to their membership, as described in point 4 of these Conditions.
2. How can I join the Familia Torres Wine Club?
To register for the Familia Torres Wine Club please fill in the online form on the website Online Wine Club | Familia Torres Wine Club. You will need to accept these membership terms and conditions.
3. Which quota suits you best?
If you have chosen a bronze, silver or gold subscription in the "Subscriptions" section of our website, Familia Torres Wine Club members can choose any of the following subscription fees:
- Wine Case 1: contains 6 (six) 75 cl (seventy-five centilitre) bottles of wine selected by Familia Torres Wine Club.
Each box is valued at €55 (fifty-five euros).
The member who chooses this option must pay a quarterly fee of €55 (fifty-five euros).
- Wine Case 2: contains 6 (six) 75 cl (seventy-five centilitre) bottles of wine of each selected by the Familia Torres Wine Club.
Each box is valued at €85 (eighty-five euros).
The member who chooses this option must pay a quarterly fee of €85 (eighty-five euros).
- Wine Case 3: contains 3 (three) 75 cl (seventy-five centilitre) bottles of wine of each selected by Familia Torres Wine Club.
Each box is valued at €125 (one hundred and twenty-five euros).
The member who chooses this option must pay a quarterly fee of €125 (one hundred and twenty-five euros).
Members who have not chosen a category will be part of the Friends category. This category is not subject to the payment of any fee and is subject to the benefits provided for in point 4 for this category.
Each member must choose at least one subscription fee and may choose more than one subscription fee if they wish.
As well as these fees, the Familia Torres Wine Club offers the benefits set out in point 4 of these conditions. Benefits will be communicated to members as they become available, and members will be informed of any updates/modifications.
The products contained in the boxes comply with current Spanish legislation and with the standards applicable in Spain. Moreover, each product is accompanied by an exact description of its main characteristics.

These benefits may be updated/modified by Familia Torres Wine Club. Any updates/modifications will be communicated in advance to the members.
5. How are the instalments paid?
Membership fees are charged to the card number provided by the member to the Familia Torres Wine Club on registration through the website, as an on-line purchase, and will be invoiced quarterly (March, June, September and December), coinciding with the shipment of the cases.
Notwithstanding the foregoing, the Member may change the card details at any time in the "My Subscription" section of the Private Area of the Website.
The following credit cards are accepted: Visa, Visa Electron and Mastercard.
The validity of the credit card number will be verified, and the credit card checked to ensure that it is not blocked. This is done on the payment gateway "STRIPE", managed by Stripe Payments Europe, Ltd.
In accordance with our commitment to payment security, we inform you that "STRIPE" verifies the bank details provided by each member.
The Familia Torres Wine Club will communicate that it will charge the fee to the credit card 7 (seven) days in advance. The charge communication will be done by sending a newsletter to the member.
The Customer's card is charged within a maximum of 7 (seven) calendar days from the date of the debit notification referred to in the previous paragraph, which will be considered effective after confirmation of the agreement between the payment centres.
All transactions are carried out within a strict framework of confidentiality and encryption thanks to the SSL protocol through a payment gateway.
6. How do I cancel my subscription?
Subscriptions can be cancelled at any time. If the payment of an instalment has been processed or a case is in the process of shipment, the provisions of the fifth and seventh condition respectively shall apply.
Once the cancellation has been processed, all the benefits associated with Familia Torres Wine Club membership as set out in points 2 and 3 of these terms and conditions will be cancelled.
7. How will I receive the cases?
Shipping of the case.
The Familia Torres Wine Club will send the case quarterly, each March, June, September and December. In particular, the goods will be shipped during the last 15 (fifteen days) of the aforementioned months.
Delivery will be made to the postal address provided by the member in the "Private Access", "My Subscription" section of our website. We only ship to Spain (Peninsula, Balearic Islands, Canary Islands, Ceuta and Melilla).
Notwithstanding the foregoing, the member may change the delivery address at any time, if the delivery is not in progress, through the "Profile" section of the Private Access Area of the website www.torres.es .
In any case, delivery is conditional upon prior payment by the member of the corresponding fee in accordance with the provisions of these terms and conditions.
Order tracking.
If you have any doubts or queries between the time you place your order and the time you receive it, you can contact us by telephone on 93 817 73 09 or by email at wineclub@torres.es.
The member will receive an SMS informing of the expected date and time of delivery.
Problems with the delivery of the case.
If the member is not at the address indicated to receive their case, it will be given to a family member or a person living at the same address. If delivery is unsuccessful, a notice will be left with the member with full details of the shipment and a contact telephone number for the transport company to set a new delivery date.
If the member does not contact the transport company within 2 (two) days after the first attempt, the agency will contact the member to arrange a new delivery.
At the time the member receives their case, they must:
- Check the conformity of the goods received at the time of delivery.
- Point out any anomalies on the delivery note, noting any reservations and signing the note.
- If necessary, please forward the articles to the Familia Torres Wine Club. The transport company will contact the member to arrange a date and time for collection. The goods must be accompanied by the original delivery note.
If the delivery of the case is delayed or does not arrive at its destination, the member can contact the Familia Torres Wine Club by sending an email to wineclub@torres.es, or by calling 93 817 73 09
If a case could not be delivered and is returned (incorrect address of the member, collection deadline expired...etc.) the member will be automatically notified by email. If the member does not contact the Familia Torres Wine Club within 1 (one) month of the Familia Torres Wine Club’s sending the aforementioned email, the Familia Torres Wine Club will cancel the membership in accordance with the provisions of these terms and conditions.
General conditions of return.
In accordance with the provisions of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users, the member has a cancellation period of 14 (fourteen) calendar days from the date of the charge of each quarterly fee, and must complete the cancellation form contained in the "Subscription Management" section of the website www.torres.es where you can download the cancellation form.
The right of cancellation cannot be exercised if there are signs that the box has been opened, tampered with or exposed to unsuitable conditions. It is compulsory to return the case properly protected, in its original packaging.
No parcel will be accepted if it lacks any of the sender's identifying details (name, surname, address, order number). On returning the case, the corresponding quarterly fee will be refunded.
This amount will be paid to the member within a maximum of 7 (seven) days of receipt of the case at the Familia Torres Wine Club premises. Amounts paid shall always be refunded using the same payment means as those used by the member.
In all cases, an email will be sent to the member informing them of the refund.
Generally, return costs are borne by the member. Exceptions include returns that derive from an error by the Familia Torres Wine Club or from a defect in the product, in which case the provisions of clause 7.3 below will apply.
Familia Torres Wine Club will not accept any exchange or refund if no prior notification has been received. Cash on delivery will not be accepted.
In accordance with banking legislation, no refunds can be made on expired credit cards. In this case, the Familia Torres Wine Club reserves the right to ask the member for all the necessary information to make the corresponding reimbursement.
Product Warranty
At the Familia Torres Wine Club, we regularly taste the products we deliver to our members, and our product rotation is high, which allows us to detect any anomalies. However, some bottles may not reach their destination in good condition. In this case, we will replace it with another one free of charge, without prejudice to the provisions of clause 5.1 above.
In such a case, the Familia Torres Wine Club undertakes to exchange the defective product for an identical one or to refund the amount of the fee, assuming the cost of return and subsequent shipment if applicable.
The shipping packaging is designed to avoid breakage and our partners are aware of the fragility of the product, but breakages may occasionally occur.
As soon as you receive your package, please follow the steps below:
- Checks the conformity of the goods received at the time of delivery.
- Point out any anomalies on the delivery note, noting your reservations or comments along with your signature.
Transport providers do not allow the return of the goods if the member opens the box in their presence, but members should inspect the outside of the box and if they detect that it is wet or damp, they should not accept the shipment. The transport agency will notify us of the incident, and we will automatically send a new shipment at no additional cost.
Similarly, members must be aware and accept the risk that, because of their characteristics, age or nature, certain products may be rapidly affected by external causes that are in no way attributable to the Familia Torres Wine Club.
If the bottles received do not correspond to your quota, or the product is defective, simply send an email to wineclub@torres.es or contact us on 93 817 73 09 indicating your details and those of your order and we will replace the order free of charge.
9. Amendments to these Conditions
The information that appears on this website is accurate at the date of the latest update. Familia Torres Wine Club reserves the right to make, at any time, as many changes and modifications as it deems appropriate, unilaterally modifying the terms and conditions of membership of Familia Torres Wine Club, and may exercise this right at any time.
Any changes shall be notified accordingly, respecting consumers' rights at all times. The entry into force of the modifications of the membership conditions shall become valid as of their publication on this web site, as well as of the communication, if any, to the members of the Club.
If the member does not agree with the modifications made, he/she may process the withdrawal of the membership to the Familia Torres Wine Club, at any time, in accordance with the provisions of these terms and conditions.
10. How does the Familia Torres protect your data?
As a member of the Familia Torres Wine Club, your data will be processed as follows:

- To whom will we communicate your data?
As a member, we may communicate your data to third parties who will act as data controllers, and who will therefore determine the purposes and means for which they will use your data. These third parties may be logistics companies for the delivery of goods to the address indicated, fraud prevention and payment management companies, such as Stripe Payments Europe, Ltd., who will process your data for the purposes of payment management and anti-fraud control of the transactions you make. It may be that if you inform us that you wish to take part in one of the activities or experiences that the Familia Torres Wine Club offers its members, your data may be communicated to third party companies so that they can carry out the activity.
This communication shall be made in accordance with the contractual relationship between the two parties.
Except for the data communications indicated in the previous paragraph, your data will not be transferred, sold, rented or made available in any other way to third parties, with the exception of those service providers who perform certain activities for us (database management, etc.) but who will not process the data for their own purposes under any circumstances.
Some of these providers may be located outside the European Union or the European Economic Area as indicated in the following section.

- Are we profiling and making automated decisions?
As described below, we may profile users, taking into account all the information they have provided.
These profiles will take into account, for example:
- Your behaviour on the website, based on those products selected, cursor movements, interests, preferences, products purchased.
- Behaviour towards our communications.
- Interaction that you may perform through other channels such as queries in our information channels, or contact.
- Information you may provide to us through satisfaction surveys.
We also inform you that, for some services, we may process your personal data using automated means. This means that certain decisions are taken automatically without human intervention, for example, segmenting you according to your interest in certain sections of the website or your use of other services we may offer.
If you have accepted to receive commercial communications, we may adapt and personalise them, according to the interests of the users, either based on the products and services requested, or based on data that we can deduce or obtain from your browsing, interest in certain content, or reactions to our communications, among others.
This personalisation is partially automated, in the sense that we determine the parameters of the personalisation, but it is the technological platform that generates the user's profile. All data provided will be retained for the period indicated in section b) of these Conditions.
Notwithstanding these time limits, your data may be retained in anonymised form for statistical or market research purposes, where possible, or appropriately blocked if necessary to comply with our legal obligations which may require us to retain certain data for a specified period.
- Why can we process data based on legitimate interest?
As indicated in paragraph b) of these Conditions, we may process data based on legitimate interest. This processing allows us to offer better services, better adapted to our users’ preferences, providing quality and personalised content. As well as our own interest, we have also assessed whether such processing also meets our users’ legitimate interest. In any case, the necessary weighting has been carried out to ensure that our legitimate interest does not prevail over our users’ rights and freedoms.
You may at any time request further information about the weighting of legitimate interests by contacting our Data Protection Officer at the address indicated in section 8 of these Conditions. We would like to take this opportunity to remind you that you have the right to object to processing on the grounds of legitimate interest.
- How can I exercise my rights and/or contact the Data Protection Officer?
You may exercise your rights of access, rectification, deletion, opposition, limitation of processing and portability of your data by writing to Miquel Torres i Carbó, 6, 08720 Vilafranca del Penedès (Barcelona) or by e-mail to the following address dataprotect@torres.es Including the reference "Personal data" and in both cases providing a photocopy of your ID card or passport, if necessary.
You may also withdraw your consent to processing operations based on consent and/or object to other processing operations where this is possible in accordance with the regulations in force. Notwithstanding the foregoing, revocation/opposition to any processing may mean that we are unable to provide any service.

11. Trademarks
All trademarks, logos and anagrams shown on this site are the property of MIGUEL TORRES, S.A., and/or other companies in the group to which it belongs and/or third parties, with the corresponding licence always being available. It is expressly forbidden to use, without prior consent, any item belonging to Torres that is subject to protection in accordance with current legislation on industrial property. In particular, trademarks, trade names, shop signs, names, logos, slogans or any other distinctive signs belonging to Torres may not be used without the written permission of Torres or the third-party company.
12. Legal action
MIGUEL TORRES, S.A. and/or third-party licensors reserve the right to take appropriate legal action against members who violate or infringe the present conditions of membership of Familia Torres Wine Club, as well as any other rights of Familia Torres Wine Club.
The relationship between the Familia Torres Wine Club and the member is governed by current Spanish legislation and any dispute shall be submitted to the courts and tribunals of the member's domicile.
13. Online dispute resolution
In relation to the resolution of consumer complaints online, Art. 14.1 of the European Commission Regulation 524/2013 provides consumers with a platform to lodge their complaints, which is available at the following link http://ec.europa.eu/consumers/odr/
